Sports Leagues Gang Up On New Jersey With New Legal Brief

The state of New Jersey has began the process of challenging a 1992 federal law that outlawed sports betting in the US. Late last year, voters approved sports betting in New Jersey, but the state must first pass the federal legal hurdle before opening sports books.

Late this past week, New Jersey learned that there will be additional legal battles to fight in their effort to end sports gambling prohibition. The four major sports groups have partnered in a new lawsuit filed to stop New jersey from moving forward with sports betting.

The actual lawsuit against New Jersey was filed back in August, when the NFL, NBA, NHL, and MLB filed suit against Governor Chris Christie. New Jersey then answered that lawsuit by requesting it be thrown out of court. On Friday, the leagues took their turn in court by responding the state's request to throw out the suit.

The NCAA is also involved in the lawsuit, and has gone as far as threatening to pull major championship competitions out of New Jersey should sports books become legal in the state.

Legislators answered voter approval from last year when they passed a bill that would allow sports books at Atlantic City casinos. Senator Raymond Lesniak has been the strongest voice pushing the sports betting, and it was Lesniak, along with Christie, that filed the federal suit, claiming the 1992 law was unconstitutional.

NBA Commissioner David Stern, who is on record last year claiming that he could see legal sports betting on the NBA in the future, attacked New Jersey for going after the 1992 law. Stern mentioned that the state was looking to "make a buck or two," but clearly there is more at stake than that for New Jersey.

The sports betting industry is estimated as a multi-billion dollar industry, with most of the best being placed currently either with illegal bookmakers, or at overseas websites.

Last year, several Las Vegas sports book executives estimated that the Super Bowl alone had wagers equaling over $100 million.

The NFL has long had a stance denouncing betting on their sport, although their stance has drawn criticism in recent years since the league has allowed owners to partner with local lottery operations. The NFL also runs a multi-million dollar betting business of fantasy football, where people choose players through a draft and then win or lose based on their full roster of players.

t's not every day you can say that a camel has shared your breakfast - unless you're Nathan and Charlotte Anderson-Dixon. Each morning they and their 18-month-son Reuben are joined by pet camel Joe, who pokes his head through their conservatory window to help himself to something to eat. The three-year-old happily munches eats bread, fruit and cereal plucked from the table at the family's detached country farmhouse. Joe, who measures 17.5 hands, loves bananas on toast but hates toast with cheese or Marmite. He lives with four other camels but is the only one to share breakfast with his owners. The others have to eat hay, barley, straw and corn mix in their stable in Ashbourne, Derbyshire. Nathan, 32, has owned Joe for two years and uses him for camel racing.

LONDON (Reuters) - Former UBS trader Kweku Adoboli told a London court on Tuesday he had "lost control" of his trading in the summer of 2011 but insisted he never acted dishonestly in the frantic weeks that resulted in losses of $2.3 billion.

Adoboli also attacked the culture of investment banks, arguing that compliance rules were "aspirational" and that traders knew they had to bend rules to achieve the goals set by senior management.

The 32-year-old British-educated Ghanaian, who used to be a senior trader on the Exchange Traded Funds (ETFs) desk at UBS's London offices, was arrested on September 15, 2011. He denies two counts of fraud and four of false accounting.

The prosecution says he traded far in excess of his risk limits and concealed his positions with fictitious accounting. Adoboli says everything he did was for the benefit of UBS.

The ex-trader said his troubles started on July 1, 2011, when, under intense pressure from fellow traders and managers, he abandoned a long-standing bearish stance and flipped his trading position to a long one. Just after he did so, the market started to sell off.

"I lost control. The result of that loss of control was an increasing number of breaks (accounting problems), a more frantic trading activity, a less controlled decision-making process," he said.

Later that month, as losses mounted in a volatile market, Adoboli recalled that exhaustion and stress levels reached such a peak that it caused him to briefly break up with his long-term girlfriend.

He said that on the evening of July 23 the couple had been supposed to go out for dinner but he found himself unable to talk to her.

"I went a bit catatonic. I was curled up on my bed. She was asking me what was wrong. I just couldn't explain," he said.

About two weeks later he reunited with his girlfriend and she, over time, persuaded him to stop trying to recoup the losses and open up to someone about his true position.

"In the end she was the strength. She was the person who said to me 'Look, Kwek, if you can't do this, if you can't fix this, then look within yourself and maybe go and tell someone.'

"This is going to kill you. You can't keep fighting this battle that you are clearly not winning," Adoboli quoted his girlfriend as telling him.

He said that by the end of August he came around to her point of view.

"I had told loads of people different stories about what the trades were to buy us more time to recoup the losses. Eventually I accepted that I would have to tell someone about the true nature, the full scale of the losses," he said.

MORE RISKS, MORE PROFIT

In a separate strand of his evidence, Adoboli said he did not believe he had done anything dishonest because he was trying to deliver what UBS management wanted: greater risks in pursuit of greater profits.

He said that in the spring of 2011 the ETFs desk was doing so well that it was held up as an example to other UBS trading desks.

"There were no secrets. There was no hiding. There was no holding back," he said, describing that period.

"We were told to go for it. We went for it. We were told to push the boundaries ... We found the boundary. We found the edge. We fell off the edge and I got arrested," he said.

Adoboli said UBS and investment banks in general set traders unrealistic objectives and everyone knew they could only be met with a certain amount of rule-bending in areas like risk limits.

"The policies were aspirational policies, and on the ground - at the coalface - you had to put in place mechanisms to achieve what you had to achieve," he said.

"In order to achieve what the bank leadership wanted us to achieve, we cannot stick to the policy. We are allowed, it is approved, in reality, that we're going to try to meet in the middle somewhere."

How Hurricane Sandy became a snowstorm

Sandy just won't quit. The hurricane-turned-post-tropical-cyclone blew through the Caribbean last week, killing at least 69 people, most of them in Haiti and Cuba. Sandy then churned up the U.S. East Coast, making landfall Monday night in New Jersey and bringing massive floods to Atlantic City, Manhattan and other coastal areas.

And now Sandy is a snowstorm.

Thanks to a collision with cold air flowing from the Arctic, the post-tropical storm (so called because it has moved out of tropical latitudes), has so far dumped 26 inches (66 centimeters) of snow on Redhouse, Md., 24 inches (61 cm) in Alpine Lake, W.Va., and 18 inches (46 cm) in Newfound Gap, Tenn., according to The Weather Channel's Mike Bettes.

The National Weather Service (NWS) has issued blizzard warnings for high-elevation areas of the central Appalachians, and a swath of lower elevation areas from western Maryland southwest into eastern Tennessee and western North Carolina are under winter storm warnings and advisories. Sandy's remnants could drop up to 3 feet (0.9 meters) of snow in parts of West Virginia and up to 2 feet (0.6 m) in southwestern Virginia and eastern Kentucky before moving into Canada on Wednesday, according to the NWS. The transformation of Sandy from rainstorm to snowstorm is a consequence of a blast of Arctic air that has fed the storm even as it has moved out of tropical waters. Normally, a tropical storm like Sandy would weaken as it moves northward into cooler waters. But a dip in the polar jet stream has fueled the storm, prompting some to call it a "nor'eastercane," a combination of hurricane and nor'easter. Nor'easters are storms driven by frigid polar air. (The moniker "Frankenstorm" also stems from this weather mash-up.)

This polar air on Sandy's western side is turning rain to snow ? a situation that's not entirely unprecedented.

According to the Washington Post's Capital Weather Gang, a "snowicane" hit upstate New York and New England in 1804, and 1962's Hurricane Ginny dumped snow in Maine. In 2005, the Category 5 storm Wilma fed into a nor'easter that dropped up to 20 inches (50 cm) of snow in West Virginia and New England.

Beyond Structured Settlements: Stone Street Capital v. McClendon

A Louisiana state court has ruled in Stone Street Capital v. McClendon that MetLife and Travelers had no right to withhold a structured settlement payment from Stone Street Capital which Stone Street had previously purchased, with court approval pursuant to the Louisiana structured settlement protection act, despite the original annuitant/payee's death prior to the payment date.

This 2012 case, which was featured in a presentation by Earl Nesbitt at the NASP 2012 Annual Conference, reinforces the finality of settlement transfer orders. According to Nesbitt, it also calls into question other cases where Travelers, as owner of structured settlement annuities, has ordered structured settlement annuity issuers to stop making payments to transfer companies following the death of the original annuitant/payees despite existing court orders approving those transfers.

Background

• In 1990, Shelia McClendon entered into a structured settlement in which Travelers Insurance Company, as assignee, purchased an annuity from Travelers Life and Annuity Company, which later became MetLife Annuity Company of Connecticut in 2006.
• On July 27, 2007, Shelia McClendon entered into a purchase and sale agreement with Stone Street Capital to sell her right to a $51,800.51 payment due October 15, 2010.
• On September 20, 2007 the same court which subsequently heard the Stone Street v. McClendon case signed an order approving the transfer.
• In the 2007 transfer proceeding, Stone Street gave proper notice to MetLife (as annuity issuer) and Travelers (as annuity owner) neither of whom raised any objections.
• MetLife subsequently sent a letter to Stone Street advising that MetLife would make the assigned payment to Stone Street in compliance with the order.
• The transfer order provided an indemnity, allegedly requested by Travelers and MetLife, to protect them from any further suit by any party asserting an ownership claim or a right to the assigned payment.
• Shelia McClendon died in 2008.
• Pursuant to instructions from Travelers, MetLife did not pay Stone Street the October 15, 2010 payment when due.
• Following Stone Street's inquiry, MetLife and Travelers informed Stone Street that other persons had competing demands for the October 15, 2010 payment and, to resolve the conflict, Stone Street must file a declaratory judgment action which Stone Street did file.
• On July 15, 2011, Travelers filed a preemptory exception of nonjoinder of indispensable parties.
• Travelers' exception claimed Shelia McClendon had passed away and that both her estate and the estate of Peatrice Jackson, whom Travelers claimed was the annuity beneficiary, were indispensable parties to Stone Street's declaratory judgment lawsuit.
• On August 4, 2011 MetLife answered Stone Street's petition and included a reconventional demand for consursus (a form of interpleader).
• None of the parties disputed, either at the time of the 2007 transfer hearing or at the time of the subsequent declaratory judgment suit, that Stone Street properly complied with Louisiana's structured settlement protection act.

Stone Street's Argument

• The declaratory judgment action was filed against MetLife and Travelers and also against the parties Travelers told Stone Street to file against.
• Stone Street subsequently asserted, however, that MetLife was the only party against whom Stone Street needed a judgment in this lawsuit.
• Therefore, Stone Street asked that everyone else be dismissed from Stone Street's motion for summary judgment.
• According to Stone Street, the declaratory judgment proceeding should not have been necessary.
• Stone Street fully complied with the Louisiana structured settlement protection act and a transfer order was previously entered without objections from MetLife or Travelers.
• The 2007 transfer order required MetLife to make the October 15, 2010 payment to Stone Street.
• MetLife ignored their own prior letter wherein MetLife stated it received the order and agreed to comply.
• The principle of res judicata should prevent MetLife from pleading concursus because its claim was previously prosecuted to judgment.
• Traveler's request for a declaratory judgment and MetLife's consursus proceeding represented "improper accumulations of actions".
• Although some state structured settlement protection statutes require a change of annuity beneficiary, the Louisiana statute does not because beneficiaries are not required to receive notice or be named parties.
• Louisiana law further holds:
  • Until a person dies that person has the right to sell assets that person owns.
  • Except for irrevocable beneficiaries, no one has a vested right to the status of a beneficiary under a life insurance contract if the death of the insured has not occurred.

MetLife's Argument

• Neither MetLife nor Travelers were parties to the 2007 transfer order so that order had no res judicata effect on MetLife.
• Travelers, the annuity owner, told MetLife not to make the October 15, 2010 payment to Stone Street.
• Nothing in the 2007 transfer order addressed what would happen to the October 15, 2010 payment if Shelia McClendon died prior to that date.
• When Shelia McClendon died, her named beneficiary in the annuity contract was Peatrice Jackson who predeceased McClendon.
• Peatrice Jackson's heirs filed a competing claim for the October 15, 2010 payment.
• Although Stone Street alleges Shelia McClendon filed a request to change her annuity beneficiary, neither MetLife nor Travelers had any record of receiving this request.
• Because a discrepancy existed among the documents submitted to MetLife, a concursus proceeding became necessary and appropriate.

Travelers' Argument

• The Louisiana structured settlement protection act did not impact Shelia McClendon's settlement agreement.
• The settlement agreement remained valid even following the transfer agreement.
• The transfer agreement did not change either the settlement agreement or the annuity contract beneficiary designation.
• The settlement agreement and the annuity contract both provide that Peatrice Jackson, the named beneficiary, would receive the future payments in the event of Shelia McClendon's death.
• If Stone Street and Shelia McClendon had followed through on their request to name Stone Street the annuity beneficiary, this declaratory judgment lawsuit would not have been necessary.
• Travelers had no proof that Shelia McClendon made any attempt to initiate a beneficiary change.
• Therefore, material issues of fact existed concerning: 1) who was Shelia McClendon's rightful beneficiary; and 2) who was entitled to the October 15, 2010 payment.

Judgment - Louisiana District Court Judge Kay Bates:

• Dismissed MetLife's concursus with prejudice and costs payable by MetLife.
• Denied Travelers' exception of failure to join indispensable parties with costs payable by Travelers.
• Granted Stone Street's motion for summary judgment with costs payable by MetLife.
• Granted Stone Street's motion to dismiss the other defendants without prejudice.
• Ordered MetLife to remit the October 15, 2010 payment to Stone Street within 15 days of the mailing of the judgment.

Judge Bates' Reasoning

• In the 2007 transfer proceeding, Shelia McClendon and Stone Street were parties, and MetLife and Travelers were properly notified and served with the petition and order.
• Under the Louisiana structured settlement protection act, Shelia McClendon was clearly entitled to sell the October 15, 2010 payment.
• The 2007 transfer order was valid, final, and not subject to appeal as all delays had passed.
• MetLife's claims against Stone Street arose out of the same subject matter as the 2007 transfer proceeding.
• MetLife's issues existed when the 2007 transfer order was signed and neither MetLife nor Travelers objected at that time.
• Therefore, MetLife's concursus is barred by res judicata.
• Neither MetLife, nor Travelers, nor any of the other claimants had any continuing interest in the October 15, 2010 payment.
• Because Stone Street established it was entitled to the October 15, 2010 payment as a matter of law, no genuine issue of material fact remained.

A Recipe For Disease: Food Deserts and Air Pollution | Care2 ...

On my way to a party recently, I decided at the last minute to pick up a bottle of wine and some fruit to contribute to the festivities. I was already near my destination and began to drive around looking for a grocery store. After circling several blocks with no luck, I engaged my GPS, only to discover that there were no grocery stores for miles in any direction.

I was in a?food desert!

Food Deserts and Food Swamps

And as it turns out, my hometown and state, Houston, Texas are full of them. Recently, I was introduced to the notion of?food deserts and?food swamps, and I realized instantly, the same people who are suffering the ill-effects of air pollution and poor access to health care, are also bearing the brunt of almost no access to quality, nutritious food.?Some of my city?s policy-makers are aware of this and pushing to increase food access.

A?food desert, according to Dr. Ann Barnes, Medical Director for?Weight Management Services and Disease Prevention at Harris County Hospital District, is when one third of the residents in a census tract are over one mile from a full-service supermarket or grocery store.

Food swamps are communities in which there is an overabundance of high caloric, nutrient-poor foods versus healthy foods. In Texas, the uneven distribution of supermarkets statewide has resulted in large areas of residents that go without.?Texas ranks lowest in the nation for supermarket density per population.

The shortage of supermarkets particularly impacts lower-income residents with limited resources for an adequate diet. In Houston, where 21% of the population lives below the poverty line, the poor that are disproportionately affected by the lack of supermarkets live mostly on the eastern parts of the city. It is no coincidence that these areas are the same parts of the city plagued with air pollution and unhealthy conditions.

Obesity, Asthma and Air Pollution

The?Food Trust, a national research and advocacy organization, found that studies overwhelmingly indicate that people living in?food deserts suffer disproportionately high rates of obesity and other diet-related issues. And, even though asthma is not considered a diet-related disease, high incidences of asthma appear in these communities as well. Poor diet contributes to and worsens asthma. There is a direct link between?obesity and the incidence of asthma and asthma-related mortality. According to the?Cleveland Clinic Journal of Medicine, the rise in obesity rates has paralleled the rise in asthma in recent decades. And conversely, significant weight loss has been associated with improvements in both asthma control and lung function. The higher one?s body mass index, the higher one?s risk of asthma.

Food deserts are almost always?food swamps, meaning that where they are lacking in access to wholesome groceries choices, there is an abundance of unhealthy, fast-food opportunities. Sugar, processed carbohydrates (such as candy, juice, white bread, and chips), and trans fats commonly found in fast foods contribute to the inflammatory response characteristic of triggering asthma. Recently, the?Journal of Asthma published a study of over 2,000 fifth-graders showing that the regular consumption of sweetened beverages greatly increased the children?s risk of developing asthma.

Dirty Air, Asthma and Social Justice

For the children of low-income families,?food deserts,?food swamps and air pollution conspire in their communities with a one-two-three punch that makes kids sicker, poorer-performing academically, and less physically active.?Families under siege from a barrage of factors, when the air is dirty and when there is no access to healthy, wholesome food, cannot fight alone. Those of us concerned about the health of children and the welfare of our communities must band together to insist that policy-makers support strong clean air regulations for all.

Fighting ruptures ragged Syrian ceasefire

BEIRUT (Reuters) - Fighting erupted in a Damascus suburb and around an army base in northern Syria on Friday, opposition sources said, as a truce marking a Muslim holiday crumbled almost before it had begun.

Three people were killed by tank fire and snipers in Harasta, a town near Damascus, activists said.

The Syrian military had said it would hold fire on Friday morning following an appeal by international mediator Lakhdar Brahimi for a pause in fighting which has killed 32,000 people and which threatens to draw regional powers into the conflict.

But violations by both sides swiftly marred the truce.

Rebels in a northern town near the Turkish border said a sniper had killed one of their fighters early on Friday and a Reuters journalist there heard the sound of four tank rounds.

"We don't believe the ceasefire will work," rebel commander Basel Eissa told Reuters. "There's no Eid for us rebels on the front line. The only Eid we can celebrate will be liberation."

The Syrian Observatory for Human Rights said rebels were trying to storm the Wadi al-Daif army base, which is less than 1 km (half a mile) from the Damascus-Aleppo highway, and that troops had fired artillery at a nearby village.

Citing opposition activists, the British-based group also said the army had fired six rockets at the besieged Khalidiya district of Homs, wounding two people and damaging houses.

President Bashar al-Assad's forces had announced conditional acceptance of a cease fire on Thursday night.

"On the occasion of the blessed Eid al-Adha, the general command of the army and armed forces announces a halt to military operations on the territory of the Syrian Arab Republic, from Friday morning ... until Monday," the army said.

But it warned it would respond to any rebel attacks, or moves to exploit the truce to reinforce or resupply insurgents.

A commander from the rebel Free Syrian Army had said his fighters would also honor the ceasefire but demanded Assad meet opposition demands for the release of thousands of detainees.

Some Islamist fighters, including the Nusra Front, dismissed the truce before it even came into effect, but after a night of clashes in Aleppo, Damascus and the west of the country, activists had reported an initial lull in hostilities.

One exception was the southern town of Inkhil, where three people were wounded as they tried to protest after special prayers in a mosque to mark the start of the Eid, according to Rami Abdulrahman, head of the Syrian Observatory.

Several other demonstrations in the southern province of Deraa, cradle of the protests which erupted against Assad in March last year, were also broken up, Abdulrahman said.

Assad himself, who has vowed to defeat what he says are Islamist fighters backed by Syria's enemies abroad, was shown on state television attending Eid prayers at a Damascus mosque.

DAMASCUS FIGHTING

Damascus residents said on Thursday night troops stationed on a mountain overlooking Damascus targeted Hajar al-Aswad, a poor district inhabited by refugees from the Israeli-occupied Golan Heights. There were no immediate reports of casualties.

"Consecutive artillery volleys from Qasioun shook my home," said an engineer who lives in al-Muhajereen district on a foothill of the mountain, giving his name only as Omar.

The fighting pits mainly Sunni Muslim rebels against Assad, from the minority Alawite sect which is distantly related to Shi'ite Islam. Brahimi has warned that the conflict could suck in Sunni and Shi'ite powers across the Middle East.

Qassem Saadeddine, head of the military council in Homs province and spokesman for the FSA joint command, said on Thursday his fighters were committed to the truce, but demanded the release of detainees by Friday morning.

Abu Moaz, spokesman for Ansar al-Islam, which includes several brigades fighting in and around Damascus, said the Islamist group doubted Assad's forces would observe the truce, though it might suspend operations if they did.

"We do not care about this truce. We are cautious. If the tanks are still there and the checkpoints are still there then what is the truce?" he asked.

Brahimi's predecessor, former U.N. chief Kofi Annan, declared a ceasefire in Syria on April 12, but it soon became a dead letter, along with the rest of his six-point peace plan.

Violence has intensified since then, with daily death tolls compiled by opposition monitoring groups often exceeding 200.

U.N. aid agencies have geared up to take advantage of any window of opportunity provided by a ceasefire to go to areas hard to access due to fighting, a U.N. official in Geneva said.

The U.N. refugee agency UNHCR said it had prepared emergency kits for distribution for up to 13,000 families - an estimated 65,000 people - in Homs and the northeastern city of Hassaka.

Vreeland's attention to detail, her love of new and exciting images, her devotion to and ability to identify, that ethereal thing called style, come across loudly and clearly.

With her lacquered black hair and Kabuki-like face, one-time 'ugly duckling' Vreeland was her own work of art and, as the film reminds us, she was one of the most important and amusing self-made works of art of her century.

Okays~

There two types. The Flicken's and The Beobachter's . Flicken means mend. And Beobachter means watchers. A Flicken is one who tends to the veil. They make sure there are no holes, rips, or tears in it. And if there are any they are to fix it. There are three types a Flickens~

Menders- They are the ones that take care of the easy rips and tears. The ones that can be fixed by simply patching them up.

Shifters- Their the ones that take care of the ones created because one of the side has learned about things on the opposite side. They can change into a form appropriate for what ever side and try and return their mind states into believing certain things aren't real.

Erasers- one hopes to never meet one of them. They fix the hardest to mend holes and rips by completely eliminating the source of the tear or rip. These are rarely used though and have only be used once or twice over the span of all time.

A Beobachter is one that guards the veil. They make sure what is supposed too stays on it side of the Veil. There are only two types of Beobachters~

Flyers- They are the ones that can fly in order to guard the higher parts of the Veil.

Walkers- They can not fly and guard of the lower parts of the Veil.

I would be a mender in this case. This is just the basic info so just ask me any question about them if you have any.

Interesting, Blue....BUT! How would they fly? They're human, like you and me. All the laws of nature apply here. Also, the Order of Shadows bans the use of any and all magic, since it would mean that the person in question would be possessed, making them a witch/warlock (I need to add Warlocks). Other than that, very good, I'll add them once I update the Warden area. Unfortunately I won't get to that until tonight, for now, I need sleep.

Also, BlueTeddy, let me see if I have it right about what you are suggesting for shifters. The way I understood your words is that they can be either humans of non human that can change form to adapt to the appropriate world. They want to heal the veil to keep the worlds seperate.

Hmmm, this gives me an idea. I read a book recently and in it there were these creatures called Navitars. These creatures were modified to be able to pilot ships down a river of some really complex stuff that I frankly don't fully understand (the river was called the Nigh). What if these Shifters were modified humans/creatures to be a sort of mix of the two whose purpose was to fix the veil?

This is just an idea, I don't know what the plan in this case is for the RP. I could have totally interperted your post incorrectly, too, BlueTeddy. I think this sounds like an interesting idea. Looking forward to seeing this develop more!

Okay, Twil, considering everyone else has basically said "This is a great idea, but I'd like to propose my own suggestion!" I'm rather reluctant to ask, but I have two character ideas I'd love to use and think this place would be a great thread to do so. They sort of conform to your universe's laws, but I'm hesitant to simply apply, so I'll make my request here.

Idea 1: A Human who, after their entire city was massacred by Vampires, vowed revenge, and, taking up twin daggers forged specifically to slay vampires, and bringing with them a small supply of food and water, wandered off on the track of the Vampires, charging after them and into the Veil. During this time, they fight countless battles and kill several Vampires, slowly becoming weaker and weaker and yet refusing to stop, eventually keeping their body from falling apart with sheer determination until they finally hunt down the ones they seek to slay, and, avenging those they care about, finally collapse and die. However, due to their sheer will to live, they find themselves unable to pass on to the afterlife, and so end up as a ghost for a while until they finally master shaping their soul into a perfect replica of their old Human form, also compressing their soul to form replicas of the weapons they used in life. You might be asking why I went to such an extent to do this. The answer is that this would serve as a justification to the abilities "Short range teleportation" - as the character could deconstruct and reconstruct their body at will within a certain range thanks to its spiritual composition - "body enhancement/regeneration" - since they could toughen and amplify their physical abilities by compressing the composition of their soul, and could repair injuries sustained fairly quickly - "flight" - since they could just partially deconstruct their body so as to defy gravity - and "the power to create and manipulate a theoretically unlimited amount of knives" - because they can create said knives with their soul and control them at will, allowing them to effectively spam rains of throwing knives so long as they have the strength to do so. Of course, since they've replicated a Human form perfectly, they'd be susceptible to standard lethal wounds, which would simply destroy their soul and remove them from existence, and more complex injuries would take them some time and concentration to fix, so they're no immortal. Still, I really liked the idea, and thought I'd try to use it here.

Idea 2: A Human whose village was attacked by Demons, which possessed several individuals including her. Unaware of what had happened to her during the first stages of possession, she tried to follow her parents as they fled, only to be turned upon and stabbed by her own father, plunging her into despair which, ironically enough, was enough to break the possession of the Demon - but not to fully expel or subdue it - just in time to be thrown underground and shut up inside a mountain where those possessed by Demons were sealed by the villagers when actual slayers weren't available to kill them. Awakening in her new prison, the character wandered around for several years, forced to live by devouring the other fully Demon-possessed individuals in the Underground, consuming their minds with her newfound Witch abilities, as well as their souls, using the powers of the demon still inside her, and the minds and souls of the Demons that had fully and irrevocably taken them over. Eventually, due to this bizarre, abominable feeding, the minds and souls of the character and the Demon still inside her became one, turning the character into an inhuman mix of Witch and Demon while still somehow preserving her Human heart. By the time she finally fought her way out of the mountain and escaped, the disturbance inside had been noticed, and several slayers had been called to eliminate whatever creature was trying to escape, which could thus kickstart the character's intro arc as she flees from the Stalkers and from Humans in general, trying her best to conceal herself and live a normal life without succumbing to the strange and conflicting natures of Demon and Witch, but perhaps even getting caught up in the affairs of the Stalkers herself and joining them at some point in the hopes of finding a way to seal away her bizarre dual nature for good.
