1. As a lawyer, how important is protecting intellectual properties?

Well, it may not be important to all lawyers in all parts of the practice and in all jurisdictions. Many other lawyers practice in such narrow areas of specialty, and/or in such unrelated fields, that intellectual property (I.P.) issues seldom if ever come up for them. Yet for a music and entertainment lawyer like myself, intellectual property protection is an everyday, life-time concern and a regular challenge.

In theory, every business-owner should have a working knowledge of I.P. After all, one's own business name is a property, usually claimable as a trademark or service mark. So, too, might be a band's name or an artist's name.

Clearly anyone in the field of entertainment needs to have a working knowledge of intellectual property - and with respect to their own original material, they need to be vigilant in regards to protecting it. The primary areas that need to be mastered in these respects, are the I.P. areas of copyright and trademark. A good starting-point is the U.S. Copyright Office (USCO) website, to the extent an artist may not already be familiar with it. I first learned about copyright by writing to the USCO and requesting their written materials by mail. This was in the days before the Internet happened.

2. What is it like working with TV actors and musicians?

I love doing it, but for me it is business as usual. My father is an actor who started his career as a child actor in the 1940's. I grew up on tour with my Dad and my Mom while one or both of them were working on summer-stock or other performances.

I played guitar in a rock-and-roll band in high school with a piano-player named John ("Jojo") Hermann, who then became Widespread Panic's keyboard player. I played guitar in a rock-and-roll band in college with Tom Morello, who then became the guitar player for Rage Against The Machine, Audioslave, and Street Sweeper Social Club, not to mention his work as The Nightwatchman. I still play rock music with members of my college band, in what little free time I have these days.

The majority of my friends are in the arts or entertainment in some way. So, it's more than working with actors and musicians. I live with actors and musicians, and in some cases I'm related to them.

3. How does it feel to be the force behind so many forms of media?

I would never say that, because I'm not the talent in the performance or recording. Maybe my clients are, if their work gets heard or seen in any individual case. I think if there is a "force" behind all of it, it's something more akin to divine inspiration - that moment when the creativity runs right through the artist as template or conduit. Artists are original but are also a product of their life experiences, and what they have already seen and heard. The "force" of artistic creativity is a lot bigger than any one of us.

That said, I think an entertainment lawyer has to have a respect of, and also a distance from, the art form. If you lose your objectivity you can't effectively represent someone. The Hippocratic Oath of doctors is something like, "First Rule, Do No Harm". Something like that is also true for an entertainment lawyer. While the first and foremost rule is to protect the client while following the law, one special corollary for entertainment lawyers should be "Don't Impair The Art Form". In other words, don't ever substitute your own notion of artistic judgment, for that of the artist - at least not when you're working, that is. Know that the art is bigger than you.

In this respect, my clients are the force. They teach me what art really is. Every day.

4. Can you tell us a little about your early life and what led up to being an entertainment lawyer?

I grew up in a show business family, as did many other kids I knew in 1960's Manhattan. I grew up in mid-town. I always ran into celebrities, and always recognized them when I saw them - from the newspaper or my old black-and-white television. My neighbors growing up were Walt "Clyde" Frazier, Jack Dempsey, Rusty Staub, Jake LaMotta, Ken Boswell, Jim Fregosi, and Dave Marshall. I played sports at an early age. I played music at an early age. Performances are what people did, and attended, in Manhattan, and still do. I've worked in other areas of commerce, with other forms of businesses, too, but I always considered entertainment the family business - much like a boy who grew up in his father's auto-shop might be more likely to become a mechanic later on, once grown up.

The main question to me was whether I was going to be a performer, as in a baseball player or rock musician - or alternatively, work in the businesses related to those performances. By the time I made that decision, I had already lived through life on the road, and life between casting calls - not to mention with a thrown-out pitching arm and fear of tinnitus. I didn't want to spend an unspecified amount of further time lifting P.A. stacks into and out of unmarked vans, or let the gigs take any more of a physical toll on me. I was thinking long-term. I was reasonably sure that as an entertainment lawyer I could stay as close as I wanted to, to the art forms that meant something to me. I was right.

5. What other lawyers inspire you?

Any lawyer that selflessly works on causes and gives back to the community. I have worked on environmental causes in the past, and that work is the most draining type of pursuit you can ever imagine. It's all-consuming.

My main inspirations are Phil Hoffman, Esq., who was my mentor when I started in the practice of law at Pryor Cashman in New York in 1987 - as well as my entertainment law professor from UCLA School Of Law, Gary Stiffelman, Esq. What they taught me, I take with me and use, every day of my working life.

6. What advice do you have for aspiring musicians?

Well, I wouldn't want my thoughts in an article misconstrued as legal advice for any specific person in any specific situation. That kind of advice should only be sought and obtained in a one-to-one and private dialogue with counsel.

However, I can summarize the things I might say to aspiring musicians who are friends of mine. The main thing now, in 2012, is not to give up. Collectively, we have just turned the corner, in terms of the American economy, and in terms of the music industry specifically.

Many nay-sayers for the past few years doubted whether new artists could ever make money and support themselves on music ever again. Sure, in some respects it is more difficult to do, post-digital downloading. But the music industry has already re-invented itself. The center of gravity is now performance and touring revenue, and merchandise. Don't fight the new model. Embrace the new model.

Furthermore, there is so much more that artists can do now to promote sales and make themselves known, including social media. And the trend is towards eliminating the middlemen who used to introject themselves into every income-stream. Embrace the new model. Make it your own.

I used to have music friends who were afraid to use cell phones. Now, those same friends are managing their publishing businesses with secure lap-tops while on tour. The main bit of advice to music friends always is, "Empower yourself, control your own destiny, and make sure that you (or your counsel) generate all your own documents". I tend to see artists as in either of one or two groups - "Victims", and "Empowered". The fundamental distinction between the two groups, is that the "Victims" make themselves beholden to other people's documents, whereas the "Empowered" control the drafting of their own documents. With the availability of desktop-publishing since the 1980's, there is no excuse in 2012 for not controlling the drafting of the documents that affect your life or your career. There is no reason to ever blindly sign on to someone else's form. All that does is make more work for the litigators.

7. What is your opinion on the current state of the music industry?

I'm sanguine about it.

The best new feature is the ability of artists to self-distribute, either by sale of CD's on tour at retail, or over the Internet.

The worst new feature also relates to the Internet, though, too - the ability of pirates to poach material digitally, in a matter of milliseconds.

Personally, I am happy that a premium is now placed on artists doing live performances, and more of them. To me, that is what the art form is really about, anyway. There are bands re-grouping after 20 or 25 years of inactivity, and going back out on the road. In a way, it's a shame that current economic realities force them back out on the road when they earlier thought they could comfortably retire on royalties. But the fact of the matter is, it's a good thing that one or two whole new generations of music fans now have an opportunity to see and hear these bands and artists. After all, once these bands and artists are gone, all that may remain are the recordings - and the recordings just aren't the same thing as a live performance, or the meet-and-greet afterwards.

8. What's the hardest part of being involved in the entertainment industry?

Knowing that some talent remains undiscovered... and, these days, seeing a trend towards the replacement of union talent with non-union talent, which is a somewhat-related issue. The just-world-hypothesis tells us that talent and hard work should be rewarded. It often is. But it is not always rewarded. Unfortunately politics and luck sometimes play a part in the reward outcome, too.

That said, the trend towards artist self-distribution might be the panacea. The market, the public, should decide which art they want to pay to hear, see, and experience. The decision should not be force-fed to the public by the same 3 or 5 corporate conglomerates.

So I think generally, the hardest part about being involved in the entertainment industry, is knowing that the continued concentration of economic power therein, in the hands of a few rather than many, prevents a lot of good material from being heard or seen.

My hope is that this changes in my lifetime, and that I get to see it. I am going to continue to fight to make the change happen, too.

Heejun Han on American Idol Elimination: Fair and Square!


It doesn't sound like Heejun Han will be pulling an Erika Van Pelt.

The season 11 finalist was eliminated from American Idol last night, but while Van Pelt has expressed disdain for the judges' decision NOT to save her - saying in an interview that she feels shafted - Han spoke to reporters this morning and sounded at peace with the process.

"It was way too early to use their card," he said of the single veto permitted by the panel of three. "I'm pretty sure they're saving it for some other people. It was fair and square."

Han also said that performing "My Life" was his favorite moment during the run, even if Steven Tyler wasn't a fan of the comical rendition.

"We had our different perspectives," he said of his mini clash with the rocker. "I was trying to give a fun time to America because I thought it would be entertaining and fun. Maybe he took it wrong, but I can't please everyone."

What does Han see next for himself? Randy Jackson joked he should star in his own sitcom, an idea Heejan is running with:

"It should be an Asian guy who's trying to go out with really pretty blonde girl. [Laughs.] Of course, I'm not going to be picky about anything. I really want to make something out of this."

And what advice does he have for future hopefuls?

"It's The Hunger Games, but it's not killing each other. Why do you always have to be so serious when only one person is going to survive? You might as well have fun and have a thick skin and stay true to yourself."

Sunset Over Slawit: Movie Review: The Muppets


If, like me, you grew up with The Muppet Show, these little fuzzy felt characters will always hold a place in your heart. And if that's the case, the new Muppets movie gives you everything you could possibly want. A heartwarming backstory, perfectly pitched so that innocence overrules sentimentality thanks to the performances of Number One Muppet fan (and co-screenwriter) Jason Segel and Amy Adams and the songwriting talents of FotC star Bret McKenzie. Well-chosen celebrity guests (including Alan Arkin, Kristen Schaal and Jack Black - giving his best performance in years). A sneering villain with a maniacal laugh (Chris Cooper - he raps too). A Muppets tribute act featuring Dave Grohl filling in for Animal. And most of all... the gang themselves, doing what they always did best: putting on a show.

So we get Kermit fighting to maintain a brave face while everything falls apart around his little green ears. Miss Piggy being a stuck-up sow (in Paris, naturellement). Fozzie being hugely unfunny. The Swedish Chef going 'durstyburstywursty'. The chickens singing Cee-Lo Green. Gonzo jumping off a roof. (Actually, I could have done with more Gonzo.) Stadler & Waldorf being sarcastic old grumps. Beaker going 'mee-mee'... in a barbershop quartet rendition of 'Smells Like Teen Spirit'. In short, everything we laughed at till we weed 30 years ago... updated slightly with contemporary references, but not a jot of contemporary cynicism.

If you love the Muppets, you'll feel like a child again. If you don't love the Muppets... can I suggest medical help?

Star-fruit-shaped nanorods, grown in the lab from gold nanowires with pentagonal cross-sections, could dramatically improve chemical sensing techniques.

The research may help to improve sensing of organic molecules, including biomarkers for diseases such as cancer. "There are many cancers where the diagnostics depend on the lowest concentration of the biomarker that can be detected," says Eugene Zubarev of Rice University in Houston, Texas, who led the research.

The nanorods returned signals 25 times stronger than conventional smooth-surfaced nanorods when using surface-enhanced Raman spectroscopy, a popular technique for detecting organic molecules. Raman spectroscopy determines the molecular structure of compounds by measuring the way they scatter monochromatic light, usually from a laser source.

The nano star fruit boost the signal by taking advantage of gold's ability to boost electromagnetic fields locally. "Fields will concentrate at specific defects, like the sharp edges of our nano star fruits, and that could help detect the presence of organic molecules at very low concentration," says Zubarev. "If we can modify the surface roughness such that biological molecules of interest will adsorb selectively on the surface of our rugged nanorods, then we can start looking at very low concentrations of DNA or cancer biomarkers."

North Sea gas leak exclusion zone

The BBC understands workers were told 'this is not a drill', before being evacuated

Exclusion zones have been put in place around the Elgin platform in the North Sea, which has been suffering a serious gas leak since Sunday.

Coastguards said shipping was being ordered to keep at least two miles away and there was a three-mile exclusion zone for aircraft.

A cloud of gas was reported to be surrounding the platform, which is located 150 miles (240km) off Aberdeen.

Workers from a second platform and drilling rig have been removed.

Shell has moved 120 non-essential staff from the Shearwater platform and Hans Deul drilling rig, about four miles from the Elgin, because of the drifting gas.

The oil giant said the move was a "precautionary measure".

Emergency plan

Total, which operates the Elgin platform, said the situation was stable but it had not yet been able to identify the source of the leak.

A sheen of between two and 23 tonnes of gas condensate, and measuring six nautical miles in length, has been reported on the water nearby, and Total has activated its Oil Pollution Emergency Plan.

Jake Molloy, of the RMT union which represents offshore workers, said many had been watching the Old Firm game between Rangers and Celtic when the alarm was raised on Sunday afternoon.

He said: "Just as it finished a PA announcement went out to say everyone was to go to the muster point and this was not a drill.

"The stand-by vessel had identified the sea boiling, as it were, below the installation - suggesting there was gas coming up there and there was some kind of vapour cloud sitting on the surface of the sea."

David Hainsworth, health, safety and environment manager for Total E&P UK, told BBC Scotland's Good Morning Scotland programmme the situation was "stable" and there had been no major change overnight.

He said: "We've been monitoring overnight. There seems to be no evolution in the rate of gas release.

"The area was over-flown twice yesterday by spotter planes to look at the sheen on the sea - that is about the same, at six nautical miles in length."

Mr Hainsworth said all the power was turned off when the platform was evacuated to minimise the risk of igniting an explosion.

He added: "Clearly there is a risk of ignition and a fire.

"We've taken away all the usual sources of ignition such as electrical power but yes there is a possibility.

"We believe it is low but you never say never."

Mr Hainsworth said they were evaluating the options for dealing with the leak.

Options include drilling a relief well - a process which could take many weeks.

Another possibility could be to carry out a "dynamic kill" - pumping heavy mud into the well to suppress the flow of gas.

Mr Hainsworth said there was a possibility that the leak could stop of its own accord.

He said: "I would say the best case scenario is that the gas is not very productive from this area and that it dies off over the coming days and weeks."

Very flammable

Dr Simon Boxall, an oceanographer at Southampton University, told BBC Scotland that this was not a deepwater drilling rig and platform but it was unusual in that they were drilling down 5km (3.1 miles) into the sea bed.

He said: "It is a very deep well. The gas they are bringing up is what we call sour gas.

"That gas has a high proportion of hydrogen sulfide and carbon dioxide and that makes it very flammable and quite poisonous.

"So the big problem they have got is dealing with a very combustible gas - unlike Deepwater Horizon where we were dealing with crude oil which ironically is very difficult to light sometimes."

Further complications

Dr Boxall said it would be tricky to get close to the leak.

"I am guessing they are going to tackle it from beneath the surface to start with," he said.

"On the one hand the Total spokesman said there was no gas bubbling through the sea and yet the observer talked about the sea boiling.

"It seems unusual that it is not bubbling through the sea and that is going to add further complications of hydrogen sulfide going into the water - certainly causing widespread poisoning in the vicinity of the rig."

Dr Boxall said it was a very focused and localised issue but one which would be very difficult to tackle.

All 238 workers were removed from the Elgin installation and the nearby Rowan Viking drilling rig by helicopter on Sunday.

Shell confirmed on Monday evening it was flying non-essential personnel back to Aberdeen from its Shearwater platform and the nearby Hans Deul drilling rig.

The UK Department of Energy and Climate Change (DECC) has been monitoring the situation and said there was no indication of a risk of significant pollution to the environment.

New SCUBA-2 camera reveals wild youth of the universe

ScienceDaily (Mar. 27, 2012) ? A team of astronomers from the UK, Canada and the Netherlands have commenced a revolutionary new study of cosmic star-formation history, looking back in time to when the universe was still in its lively and somewhat unruly youth! The consortium, co-led by University of Edinburgh astrophysicist Professor James Dunlop, is using a brand new camera called SCUBA-2, the most powerful camera ever developed for observing light at "sub-mm" wavelengths (light that has a wavelength 1000 times longer than we can see with our eyes). Prof. Dunlop will present the first results from the survey on?March 27 at the National Astronomy Meeting in Manchester.

SCUBA-2 is mounted on the world's largest sub-mm telescope, the 15-metre James Clerk Maxwell Telescope (JCMT), located atop the 4,300-metre high peak of Mauna Kea in Hawaii. The new project, named the SCUBA-2 Cosmology Legacy Survey will run for 3 years and will use the camera to provide the clearest view to date of dust-enshrouded star-forming galaxies. These objects are so remote that the light we detect left them billions of years ago, so we see them as they looked in the distant past. With SCUBA-2 astronomers are able to study objects that existed as far back as 13 billion years ago, within the first billion years after the Big Bang.

Because stars form inside clouds of gas and dust, much of the ultraviolet light from young galaxies is absorbed by this cosmic dust which is then heated to a few tens of degrees above absolute zero (-273 degrees Celsius). The "warmed" (but still rather "cool") dust then remits the absorbed energy at far-infrared wavelengths, which is then further redshifted to longer sub-mm wavelengths en-route to Earth by the expansion of the Universe.

Detecting such emission is a challenge, both because Earth-based telescopes are warm and hence glow at sub-mm wavelengths and because water vapour in the atmosphere both absorbs and emits light in this waveband. To get around the problems of the atmosphere, the latest sub-mm surveys have recently been conducted from space, using the Herschel Space Observatory. However, the relatively small size (3.5-metre diameter) of Herschel means that the images it produces, while covering large areas, are rather fuzzy. Because its primary mirror is 20 times larger in area, the James Clerk Maxwell Telescope, now equipped with SCUBA-2, can provide a much sharper view of the sub-mm sky, especially on those occasions when the sky above the high mountain tops in Hawaii is really dry.

The SCUBA-2 Cosmology Legacy Survey is being targeted at areas on the sky which have already been studied in detail by other telescopes observing at different wavelengths. Of special importance is the Hubble Space Telescope (HST), which is undertaking a major 3-year survey (called CANDELS) of the visible light emission from high-redshift galaxies with its own new camera, Wide Field Camera 3 (WFC3). By combining the JCMT and HST imaging astronomers can gain an unparalleled view of the most massive galaxies which roamed the Universe back in the "golden era" of star formation activity.

The first image presented here is made using the SCUBA-2 camera at a wavelength of 450 microns. Zooming in, it shows seven distinct sub-mm sources that appeared blended together in the poorer-quality Herschel image. The Hubble images then show that the SCUBA-2 sources are massive, clumpy, violently star-forming disc galaxies, seen at a time when the Universe was about a quarter of its present age.

Prof. Dunlop is delighted by these first deep SCUBA-2 images and looking forward to more results over the next few years. "Edinburgh scientists and engineers worked hard to construct this revolutionary new instrument and, together with our colleagues in Canada and the Netherlands, we're now seeing the fruits of our efforts. With SCUBA-2 we can study the most violently star-forming galaxies in the young Universe, and slowly but surely start to understand how the primitive cosmos evolved into the universe we live in today."

Judges: Ireland's ex-PM took secret payments, lied

Irish Prime Minister Bertie Ahern denied doing anything wrong, but resigned from office in 2008 after 11 years in power.

DUBLIN -- Former Irish premier Bertie Ahern lied about the source of substantial sums of money he received, an inquiry concluded on Thursday in a long-awaited report into the dealings of one of the architects of Ireland's ill-fated economic boom.

The verdict comes four years after the economy collapsed under the strain of a decade-long housing and banking boom, cultivated by Ahern and his Fianna Fail party, and a year after the party was ejected from power by angry voters.


Set up in 1997, the Mahon Tribunal probed the relationships between politicians and property developers after builders made vast profits on land re-zoned as commercial.

'Endemic' corruption
In its report it said corruption was "endemic and systemic" at every level of government in Ireland in the late 1990s. Ahern was Taoiseach, or prime minister, from 1997 to 2008.

Irish PM resigns over cash-payments scandal

Ahern was one of Europe's longest serving premiers and widely praised for his work in resolving a three-decade conflict in Northern Ireland.

The three judges led by Justice Alan Mahon found that Ahern received at least ?209,779 ($276,000) in secret payments while in office and repeatedly lied about this under oath. The report stopped short of finding Ahern guilty of corruption, because they couldn't prove that Ahern gave favors to any of his cash donors when he was finance minister in the 1990s.

The judges did find two other former lawmakers in Ahern's Fianna Fail party, including former Cabinet minister and European Union commissioner Padraig Flynn, guilty of corruption for soliciting payments from property developers for personal use. They also found 11 past and present members of local councils guilty of the same offense.

Irish parliament chief quits after spending row

While the report itself was a fact-gathering effort and not a direct finding of any criminal wrongdoing, Prime Minister Enda Kenny referred its contents to state prosecutors, the national police force, tax collection authorities and the Standards in Public Office Commission. Potential offenses include corruption, obstruction of justice and tax evasion.

The report "clearly sets out corrupt practices among a number of politicians," said Kenny, who declined to say whether he considered Ahern among them.

Ahern's former special adviser in government, Gerry Howlin, described the findings as "far worse than anything I expected or believed possible."

Bizarre testimony
Ahern, whose often bizarre and implausible 2007 testimony enraptured the nation, denied doing anything wrong, but resigned from office in 2008 after 11 years in power. He issued a lengthy rebuttal Thursday night accusing the judges of unfairness and vowing to clear his name.

"I am disappointed that the tribunal has said that I failed to give a truthful account," Ahern said. "... I never took a bribe or corrupt payment. I never made a political decision in return for a payment. I hid nothing."

Yet even his own party, whose name means "soldiers of destiny" in Gaelic, failed to believe him.

Fianna Fail leader Micheal Martin announced after a late-night meeting of party lawmakers that he intended to expel Ahern from party membership. The decision was expected to become official March 30.

"The receipt by a senior office holder of large amounts of money which a sworn tribunal has held is of unclear origins, and the failure to give any credible explanation, requires an unequivocal response," said Martin, who served in three Cabinet posts in Ahern-led governments.

Trust 'betrayed'
He said Ahern's receipt of surreptitious funds, and his delivery of false testimony, "betrayed the trust placed in him by this country and this party."

No Irish politicians have been convicted of corruption as a result of investigations into the bribery culture at the heart of Irish property development. Prosecutions are hampered, in part, by the fact that the government passed no credible anti-bribery laws until 1996, leaving tax evasion as the only readily proven offense.

Ahern's longtime accountant and friend, Des Peelo, conceded that Ahern's testimony had been hard to swallow, but said the judges couldn't prove Ahern was lying.

"The fact that something is bizarre does not make it untrue. Some aspects of his finances were bizarre," Peelo said.

It investigated allegations that Ahern accepted money from a developer in return for favors, a charge he rejected. He said his finances were complex but not improper during the turmoil that followed the breakdown of his marriage in the 1990s.

Ahern had admitted to accepting an envelope filled with 8,000 pounds ($12,700) in 50-pound notes from businessmen after speaking at a function in Manchester in 1994, which he said was his speaking fee. In late 2006 it emerged friends and businessmen had lent him 50,000 euros ($66,000).

"He told me he was telling the truth," special adviser Howlin said. "His narrative is not believed, and it is damning and it is serious. ... His reputation has been very seriously damaged."
